By clicking on the “Submit” button and/or availing any of our Services and/or access/using our Platform, you agree to the Terms set-out hereunder and shall be bound by the same. If you do not wish to avail of our Services, please do not click on the “Submit” button and/or use any of our Services and/or access/use our Platform.
Our Services shall be made available to the Consumer at our sole discretion. The Consumer unconditionally confirms that the Consumer shall comply with and be bound by the Terms as in force from time to time.
1. GENERAL TERMS AND CONDITIONS
1.1 The Terms shall be made available on the Platform /or communicated to the Consumer on the email ID registered by the Consumer with us and/or through any other mode of communication if so desired by the Consumer. The Consumer shall read and understand the Terms and Frequently Asked Questions if any before availing any of our Services or making payment on our payment portal and keep itself abreast about any changes to the Terms by visiting our Platform from time to time. Any transaction done subsequent to the amendment of the Terms will be considered as Consumer's acceptance of the amended Terms.
1.2 The Consumer shall be bound by the terms and contents of our Policy.
1.3 Any decision made by us in relation to the request made by the Consumer shall be final and binding on the Consumer.
1.4 The Consumer understands and agrees that we shall either directly or through any third party appointed by us may access the Consumer’s location and any other data made available by the Consumer through our Platform for our internal purposes only.
1.5 We shall have sole right to deny any benefits to the Consumer if we are of the view that the Transaction is fraudulent, dubious, or misused and/or the Consumer has not complied with our terms.
1.6 We may provide links to other websites that are maintained by third parties. These links are provided for the convenience of our Consumers only and the provision of these links does not mean that we endorse these websites or the products and services they provide. The Consumer acknowledges and agrees that we shall not be responsible and/or liable for any information/ content or any products/ services available on these third party websites. The consumer is required to ensure its own due-diligence before availing of such services/goods.
1.7 Consumer will not reproduce, sell, resell, duplicate, and copy any part of our Services for any commercial purpose.
1.8 We reserve the right to discontinue our Services at any time at our sole discretion without giving any reason to the Consumer and/or if there are discrepancies in the information provided by the Consumer and/or the particulars provided by the Consumer and/or for any other reason whatsoever. In such cases, we reserve our right to take appropriate action as we may deem fit and proper without incurring any liability in any manner whatsoever.
1.9 The records maintained by us in relation to our Services, Transaction records including but not limited to the traces of the emails/SMS, Consumer phone recordings, etc. available with us shall be sole and conclusive proofs and shall be final and binding on the Consumer in case any discrepancy arises. We may maintain the said records for the period as we may deem fit and may share the same with any legal and/or regulatory authority as we deem fit or as per the provisions of Applicable Laws and/or for the purpose of defending or taking suitable legal actions.
1.10 We may change the mode/method of providing our Services and/or Platform including the terms and conditions applicable to our Services and/or Platform any time without giving any prior notice to our Consumer.
1.11 The Consumer shall be the sole and exclusive owner of PIN and/or code and/ or password and/or OTP (each hereinafter referred to as “Authentication PIN”) issued by Consumer’s Bank or set by the Consumer on our Platform and the Consumer shall keep the same confidential at all times. The Consumer shall accept sole responsibility for the use, confidentiality, and protection of the Authentication PIN. The Consumer grants express authority to us for processing the Transactions and instructions of the Consumer authenticated by the Consumer by providing the Authentication PIN/Fingerprint Biometrics/facial recognition of the Consumer and/or any other authentication method available on the Platform. The consumer shall provide the correct mobile number to us on which Consumer wishes to avail of our Services including Authentication PIN etc. The Consumer shall be solely responsible to ensure that the mobile number and other credentials of the Consumer submitted by the Consumer with us are correct and belong to the Consumer.
1.12 Sharing of Authenticated PIN with any other person or responding to any unauthorized SMS/
e-mail/ phone call in which the Authentication PIN, biometrics, or any other personal confidential information is asked for, shall be the sole responsibility of the Consumer and we strictly prohibit such malpractices and educate our consumers not to fall prey to such malpractices. We shall, in no manner whatsoever, be held responsible or liable, if the Consumer incurs any loss as a result of the Authentication PIN, biometrics, or any other personal confidential information being disclosed/ shared by the Consumer with any unauthorized persons or in any other manner whereby the security of the Authentication PIN, Accounts, Bank Services, biometrics or any other personal confidential information of the Consumer is compromised.
1.13 The Consumer shall immediately inform us by calling on +91-9711347474/ firstname.lastname@example.org or communicating on email id or submitting a written application with us for the following reasons-
a) if Accounts are hacked, misused or if there is any fraudulent transaction; or
b) in the event the customer’s mobile having Platform is lost/stolen; or
c) any issues/grievances in relation to Accounts /Platform/Bank Services; or
d) for any other support in relation to our Services and Platform.
1.14 Consumer agrees that a) only numbers registered on “Do Not Disturb” shall not be considered for telemarketing offers for the products offered by us. We shall not be responsible or liable for any calls, promotional messages sent on numbers registered on Do Not Disturb.
1.15 The Consumer represents and warrants that the Consumer is at least 18 (eighteen) years of age and have not been disqualified for any reason by its Company/organization / Partnership firm and/or any legal or regulatory authority for availing our Services at any point in time.
1.16 The Consumer may make a payment on our payment gateway by using/selecting the options as may be provided by us. The Consumer understands and agrees that once the payment is made, the same shall not be refunded in any manner whatsoever and for any reason whatsoever and that the payment shall be strictly made for availing our bulk SMS / promotional services / digital marketing services only.
1.17 The Consumer understands and agrees that once the payment is made and OTP is verified by the Consumer, there shall be no refund and that the Consumer shall not ask for the refund of the same.
1.18 The Consumer understands and agrees that there shall be no refund in case of any services issue on our Platform and that the Consumer shall directly approach the Service Operator for the same as Consumer is only using our platform for availing such services being offered by the Service Operator.
1.19 We may amend/terminate any of our Services any time without assigning any reason to Consumer by giving 30 (thirty) days’ notice in writing to the Consumer.
1.20 In case of any disputes arising out of the services being provided by us, efforts shall be made initially to resolve such dispute amicably within a period of 15 days from the date of raising such dispute by the Consumer. In case of failure to resolve such dispute amicably, the matter shall be referred to a single arbitrator to be appointed by us. The provisions of the Arbitration and Conciliation Act, 1996 any enactment of statutory modification thereof shall be applicable to such arbitration. The arbitration proceedings shall be in the English language. The place of arbitration shall be Delhi. The award of the arbitrate tribunal shall be final and binding upon the Parties. Courts in Delhi shall have exclusive jurisdiction.
